These terms govern your use of gophcpro.com, the PHC Pro app, and related services. By accessing or using PHC Pro, you agree to these terms. If you use PHC Pro for a company, you represent that you have authority to accept these terms for that company.

PHC Pro is a decision-support tool

PHC Pro provides general educational information, calculations, possible treatment options, workflow support, and integration features. It does not replace professional judgment, site inspection, diagnosis, laboratory testing, product labels, safety data sheets, licensing requirements, or advice from qualified local professionals and regulators.

The label and the law always come first

The pesticide label is the law. Product labels and applicable federal, state, tribal, and local laws, regulations, permits, and restrictions supersede every PHC Pro recommendation, calculation, or statement.

You are solely responsible for confirming the current label, legal use site, target pest, rate, timing, application method, tank-mix compatibility, personal protective equipment, reentry interval, environmental restrictions, licensing, supervision, recordkeeping, and every other requirement before purchasing, recommending, mixing, handling, or applying a product.

Accounts and authorized users

You are responsible for accurate account information, protecting login credentials, controlling who uses your account, and promptly reporting suspected unauthorized access. Each user must have the permissions and training required for the work they perform. You are responsible for activity under your company account.

Your data

You retain ownership of company, client, tree, property, job, treatment, estimate, and other data you submit. You grant PHC Pro a limited right to host, process, reproduce, and transmit that data only as needed to provide, secure, support, and improve the service or as otherwise directed by you. You represent that you have the rights and permissions needed to provide the data.

Third-party software connections

If you authorize a connection to Jobber, ArborGold, QuickBooks Online, or another service, you direct PHC Pro to exchange the data needed to provide that connection. You remain responsible for your third-party accounts, permissions, data, fees, and compliance with that provider's terms and privacy policy.

Third-party services are not controlled by PHC Pro. Their APIs, features, availability, security, and pricing may change or stop working. PHC Pro does not guarantee that every system will connect or that an integration will remain continuously available. You may revoke a connection through the applicable provider or by contacting us.

PHC Pro is not affiliated with or endorsed by a third-party service merely because that service is named or connected.

Your responsibilities

• Verify the tree, pest, disease, site conditions, and diagnosis.
• Use current labels, reliable measurements, and accurate job information.
• Confirm that you and your crew hold all required licenses and training.
• Review information before sending it to an estimate, scheduling, accounting, or client-management system.
• Use equipment safely and follow employer, manufacturer, and regulatory requirements.
• Do not rely on PHC Pro for emergencies, poisoning response, or medical advice.

Calculations, pricing, and estimates

You must verify measurements, units, rates, calculations, labor assumptions, costs, and pricing before use. Suggested pricing is informational and does not guarantee profitability or customer acceptance. PHC Pro may help prepare information for an estimate, but your company is responsible for the final scope, price, contract, taxes, scheduling, and customer communication.

No guarantee of outcomes

Tree response, pest pressure, weather, soil, application quality, product availability, and many other conditions vary. PHC Pro does not guarantee diagnosis, treatment success, tree survival, profitability, pricing, legal compliance, data accuracy, integration availability, or business results.

Beta and service changes

Beta features may be incomplete, inaccurate, changed, suspended, or removed. Do not use beta output as the only basis for a safety-sensitive, legal, or financial decision. We may modify, update, limit, suspend, or discontinue features and integrations.

Subscriptions and payment

Paid plans, billing cycles, renewal terms, user limits, setup fees, cancellation rules, and refunds will be shown at purchase or in an order form. Unless stated otherwise, fees are exclusive of applicable taxes. Enterprise integrations and customization depend on technical access and an agreed scope.

Payments may be processed by Stripe or another third-party payment processor. By providing a payment method, you authorize PHC Pro and its processor to charge the amounts due, including recurring subscription charges and applicable taxes, according to the plan you select. You are responsible for accurate billing information and any fees charged by your bank or card issuer. Failed or reversed payments may result in suspension of paid features.

Payment processing is also subject to the processor's terms and privacy practices. PHC Pro is not responsible for a processor's separate services, outages, security practices, or decisions to approve or decline a transaction, except to the extent required by law.

Acceptable use

You may not misuse PHC Pro, interfere with its operation or security, access it without authorization, introduce harmful code, scrape or harvest data, use it to violate law or third-party rights, resell access without permission, or reverse engineer the service except where applicable law expressly permits it.

Intellectual property and feedback

PHC Pro software, content, design, and branding are protected by applicable intellectual property laws. These terms do not transfer ownership to you. If you provide suggestions or feedback, you permit us to use them without restriction or payment, while we will not publicly identify you as the source without permission.

Third-party information and links

Product, supplier, pricing, pest timing, regulatory, and other third-party information can change. References and links are provided for convenience and do not mean PHC Pro controls or endorses the third party.

Disclaimer of warranties

To the fullest extent allowed by law, PHC Pro is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, availability, or uninterrupted operation.

Limitation of liability

To the fullest extent allowed by law, PHC Pro and its creator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, property damage, plant injury, personal injury, regulatory action, or claims arising from use of or reliance on the service. Some jurisdictions do not allow certain limitations, so they may not apply to you.

Suspension and termination

We may suspend or terminate access for nonpayment, misuse, security risk, legal requirements, or material breach of these terms. You may stop using PHC Pro at any time, subject to applicable subscription commitments. Provisions that by their nature should survive termination will remain effective.

Changes to these terms

We may update these terms as the service changes. Material changes may be communicated through the service or by email. Continued use after the effective date means you accept the revised terms.
